Probate with a Surviving Spouse in Texas

The probate of an estate with a surviving spouse and other heirs or beneficiaries can be quite complex. I’ve written about it in several articles published in the Texas Bar Journal. In 2016, I published an article on various benefits provided to a surviving spouse and children of the deceased under the Texas Constitution and Texas Estates Code, including exemptions and allowances. More recently, I published an article providing an overview of the various potential issues that may arise in the administration of an estate with a spouse, including payment of estate debts, fraud on the community, the division of authority over estate property between the surviving spouse and estate representative, and the estate inventory.
